Protection of Rights

The goal of the Rule of Law is to protect the fundamental human rights of citizens. The fundamental rights listed in the International Covenant on Civil and Political Rights are the minimum scope of rights that should be protected by law. Democratic election is one of the fundamental human rights. Protection of fundamental human rights does not necessarily constitute a damage to public order as human rights are not absolute and can be restricted. However, if human rights are to be restricted, the restriction must satisfy the requirements of a set of basic principles. To legitimately restrict human rights, the limitation must have a legitimate aim and must be necessary and proportionate.
